DMCA & Copyright Policy

the MyNest team ("MyNest") respects the intellectual property rights of others and expects users of its software, website, and services to do the same. This Digital Millennium Copyright Act ("DMCA") policy outlines the process for reporting alleged copyright infringement and filing counter-notifications.

1. Nature of MyNest Services

MyNest is designed as a private device administration and remote access tool. It allows users to connect to their own computers from their own mobile devices and web browsers. MyNest does not operate a public file-sharing service, public search index, or content directory. Files transferred or viewed through MyNest reside on the user's private hardware.

Nonetheless, to the extent that any transmission or relay passes through MyNest infrastructure, we respond expeditiously to valid notices of alleged copyright infringement in accordance with applicable laws.

2. Designated Copyright Agent

3. Filing a DMCA Notice

To be effective, your notification must be in writing and include the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
  3. Identification of the material claimed to be infringing, with information reasonably sufficient to allow us to locate the material.
  4. Your contact information, including your full legal name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification to our designated agent. Your counter-notification must contain:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location where it appeared.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and consent to the jurisdiction of the courts governing India or your local jurisdiction.

5. Repeat Infringers

It is our policy in appropriate circumstances to terminate or disable the accounts of users who are found to be repeat infringers of intellectual property rights.
