End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you and the MyNest team ("we", "us", or "our") governing your use of the MyNest desktop agent software (for Windows, macOS, and Linux) and the MyNest mobile applications (for Android, iOS, and iPadOS), collectively referred to as the "Software".

By downloading, installing, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree, do not download, install, or use the Software.

1. Grant of License

Subject to your compliance with this Agreement and our Terms of Service, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and execute the Software on compatible computers and devices that you own or are legally authorized to control.

2. License Restrictions

You agree not to, and you will not permit others to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software, except to the extent permitted by applicable law.
• Modify, translate, adapt, or create derivative works of the Software.
• Rent, lease, lend, sell, sublicense, or distribute the Software to any third party.
• Bypass, disable, or circumvent any encryption, cryptographic pairing tokens, or permission controls within the Software.
• Use the Software for any unlawful purpose or in violation of our Acceptable Use Policy.

3. Ownership & Intellectual Property

The Software is licensed, not sold. All rights, title, and interest in and to the Software, including all copyrights, patents, trade secrets, trademarks, and other intellectual property rights, remain exclusively with the MyNest team or its licensors.

4. Automatic Updates & Telemetry

The Software may periodically check for and download software updates, patches, and improvements. The Software also communicates heartbeat status (such as online status, OS version, and basic resource metrics) to your authenticated MyNest account to enable remote dashboard management.

5. Termination

This Agreement is effective until terminated. You may terminate it at any time by uninstalling the Software and deleting your account. Your rights under this Agreement terminate automatically without notice if you fail to comply with any of its terms.

6. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Software is provided "AS IS" and "AS AVAILABLE", with all faults and without warranty of any kind. We disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of Liability

In no event shall the MyNest team be liable for incidental, special, indirect, or consequential damages, including loss of data, system disruption, or business interruption arising out of or related to your use of or inability to use the Software.

8. Governing Law

This Agreement is governed by the laws of India, without regard to conflict of law principles.
